Bite Balance — The measurable blood-sugar reset program

1.About these Terms

These Terms of Use ("Terms") govern your access to and use of the Bite Balance website, mobile application, reset camps, and related services (together, the "Service"), operated by [LEGAL ENTITY NAME] ("Bite Balance", "we", "us", or "our").

By creating an account, joining a camp, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated here by reference.

Please read

2.The most important thing: Bite Balance is not a medical device

Bite Balance is a wellness and education tool. It is not a medical device, and it does not diagnose, treat, cure, or prevent any disease, including diabetes or prediabetes. It is not cleared or approved by the U.S. Food and Drug Administration (FDA), by India's Central Drugs Standard Control Organisation (CDSCO), or by any other regulator, because it makes no medical claims.

  • The blood-sugar values, peaks, curves, and Bite Balance Score shown to you are predictions and estimates of how your body is likely to respond to food. They are not clinical measurements, and individual responses vary.
  • The Service does not replace professional medical advice, diagnosis, or treatment, and it does not create a doctor–patient relationship between you and Bite Balance.
  • Always talk to your doctor or another qualified health provider before changing your medication, diet, exercise, or treatment, and never disregard or delay professional medical advice because of anything you read or see on the Service.
  • In an emergency, call your local emergency number ([e.g., 911 in the US / 112 in India]). Do not rely on the Service for urgent or emergency needs.

If you do not accept this disclaimer, you may not use the Service.

3.Who can use Bite Balance

You may use the Service only if you:

  • are at least [18] years old (or the age of majority where you live);
  • can form a binding contract with us; and
  • are not barred from using the Service under applicable law.

The Service is currently offered in the United States and India. We make no claim that it is appropriate or available elsewhere. If you use it from another location, you do so on your own initiative and are responsible for compliance with local law.

The Service is not intended for children. See Section 9 of the Privacy Policy.

4.What the Service does

Bite Balance lets you photograph a meal and receive a predicted blood-sugar response, a daily suggestion, and a Bite Balance Score, delivered through a guided 3-week reset camp with a cohort. The predictions are generated by AI models and personalize to you as you log more data. A continuous glucose monitor (CGM) is not required; an optional home fingerstick reading can improve personalization.

We may change, suspend, or discontinue any part of the Service at any time, as described in Section 14.

5.Your account

To join a camp you create an account. You agree to provide accurate information, to keep your login credentials confidential, and to be responsible for all activity under your account. Tell us promptly at [SECURITY/SUPPORT EMAIL] if you suspect unauthorized use.

6.Free camps and sponsor funding

Reset camps are generally free to join because they are funded by a sponsor — for example an employer, health plan, community or faith organization, or clinic — who benefits when their people get healthier.

  • Where a sponsor funds your camp, we may share aggregate, de-identified outcome information with that sponsor (for example, completion rates and average score changes). We do not share your individual results with a sponsor except as described in our Privacy Policy or with your consent. (See the Privacy Policy for details, including minimum cohort sizes.)
  • Where a clinician hosts a camp, information is handled as described in the Privacy Policy, and you control what, if anything, is shared back with that clinician.

7.Paid services, billing, and cancellation

Some features are optional and paid:

  • Food Response Report — a one-time purchase of $[59] (or local-currency equivalent).
  • AI Recalibration Coach — a subscription of $[12] per month (or local-currency equivalent), billed [monthly] until cancelled.

The following apply to paid services:

  • Prices and taxes. Prices are shown before purchase and may change prospectively. You are responsible for applicable taxes (for example, US sales tax or Indian GST).
  • Payment. Payments are processed by our third-party payment processor, [PAYMENT PROCESSOR, e.g., Stripe / Razorpay]. We do not store full card numbers. Your use of payment services is also subject to the processor's terms.
  • Auto-renewal. Subscriptions renew automatically each billing period unless you cancel before the renewal date. You can cancel anytime in [account settings / by emailing [SUPPORT EMAIL]]; cancellation stops future charges and takes effect at the end of the current period.
  • Refunds. [State your policy, e.g., "The Report is non-refundable once generated. Subscription fees already charged are non-refundable, except where required by law."] Nothing here limits any non-waivable statutory rights you have under applicable consumer law.

You never have to buy a paid service to join or complete a free camp.

8.Your content and the data you provide

You may upload meal photos and other information ("Your Content"). You keep ownership of Your Content. You grant us a non-exclusive, worldwide, royalty-free license to host, process, and use Your Content to operate and improve the Service for you and, in de-identified form, to improve our models and the Service generally, all as described in the Privacy Policy.

You represent that you have the right to share Your Content and that it does not violate anyone else's rights. Do not upload content that is unlawful, infringing, or that belongs to someone else without permission.

9.Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in violation of these Terms;
  • rely on the Service for medical, diagnostic, or emergency decisions (see Section 2);
  • upload malicious code, attempt to breach security, or disrupt the Service;
  • scrape, reverse-engineer, or copy the Service or its models except as allowed by law;
  • resell, sublicense, or commercially exploit the Service without our written permission;
  • impersonate others or misrepresent your affiliation; or
  • harass other members or misuse cohort or community features.

We may suspend or terminate access for violations (Section 13).

10.Predictions are estimates

You understand and agree that outputs of the Service — including predicted peaks, curves, the Gut Index, the Weight Index, the Activity signal, and the Bite Balance Score — are estimates produced by statistical and AI models. They can be wrong, they are not guarantees of any health outcome, and they are not a substitute for measurement by a medical professional. You use them at your own discretion and risk.

11.Third-party services

The Service may connect to third-party services (for example, [Fitbit] for optional activity data, payment processors, and sponsor or clinician systems). We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

12.Intellectual property

The Service, including its software, models, text, graphics, logos, the "Bite Balance" name and mark, and the Bite Balance Score, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own non-commercial use under these Terms. All rights not expressly granted are reserved.

13.Suspension and termination

You may stop using the Service at any time and may ask us to delete your account (see the Privacy Policy for data deletion). We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (for example, Sections 2, 8, 10, 12, 15–18, and 20) will survive.

14.Changes to the Service and these Terms

We may modify the Service or these Terms. If we make material changes to these Terms, we will update the "Last updated" date and provide reasonable notice (for example, by posting on the Service or emailing you). Your continued use after changes take effect means you accept the updated Terms.

15.Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that predictions will be accurate. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.

16.Limitation of liability

To the fullest extent permitted by law, [LEGAL ENTITY NAME] and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the Service, even if advised of the possibility. Our total liability for all claims relating to the Service will not exceed the greater of [the amount you paid us in the 12 months before the claim] or [USD 100 / equivalent].

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, for death or personal injury caused by negligence, or for fraud).

17.Indemnification

You agree to indemnify and hold harmless [LEGAL ENTITY NAME] and its partners from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

18.Governing law and disputes

These Terms are governed by the laws of [STATE/COUNTRY — e.g., the State of [•], USA, for US users; and the laws of India for users in India], without regard to conflict-of-laws rules. [Choose and have counsel confirm a venue / arbitration clause appropriate to both countries, e.g., "Disputes will be resolved in the courts of [•]" or a binding-arbitration clause with a consumer-friendly carve-out.]

19.Miscellaneous

If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms are the entire agreement between you and us about the Service.
